
Steve Descano — Fairfax County’s Commonwealth’s Attorney, the county’s top prosecutor — has entered agreements to have 13 accused murderers declared legally insane instead of putting them on trial, the Washington Examiner reported on August 18.
Read that number again. Thirteen.
Descano’s defense is that his office’s own expert found the defendants insane, so “there is functionally no way to get a conviction at trial.” But the prosecutor decides how hard to fight. He picks the expert. He decides whether to contest the finding, seek a second opinion, or put the case to a jury. When a prosecutor agrees to an insanity verdict for accused killer after accused killer — 13 of them — that is not a diagnosis handed down from above. It is a pattern of decisions, and Descano owns every one.
Joshua Danehower was charged in the death of Gret Glyer, a Fairfax charity founder. Descano’s team agreed to have him declared legally insane, which routes him out of jail and into a mental-health facility with a shot at release after a one-year evaluation.
Abdulloi Toshpulodzoda killed his landlord, was found not guilty by reason of insanity in 2022, and this July used a 48-hour unescorted pass to board a one-way flight out of the country, landing in Tajikistan. The insanity verdict Descano’s office agreed to is what put him in that facility to begin with.
The victims’ families are watching these releases in disbelief. They are not abstractions. They sat through it.
Descano did not build this record alone. About two-thirds of his roughly $1 million war chest came from PACs funded by George Soros — roughly $600,000 from a single Soros-backed group. He is the local franchise of a national model that runs on charging less and delivering less, and Fairfax is living in the results. The county is now talking openly about a recall.
He entered the agreements. He has not reversed them. Thirteen accused murderers, and he is on the record for every one.
