Republican Attorney General Helped Push Out Brothel That Democratic Prosecutor Tolerated

FALLS CHURCH, Virginia — Virginia Attorney General Jason Miyares, a Republican, stepped in where county prosecutor Steve Descano, a George Soros-funded Democrat, refused to, and helped shut down the brothel a few yards from a school bus stop in a residential neighborhood — and Miyares relied on the Washington Examiner’s reporting to do so.

Miyares sent the landlord a two-page letter on Aug. 5, passing along two stories about the brothel.

“The attached published reporting has come to my attention,” wrote Miyares, “which raises serious concerns about potential human trafficking in Fairfax County, and the article specifically implicates Rose Spa or L Health Center.”

Miyares noted that under Virginia law, a brothel is a “nuisance,” and thus the state could enjoin the business, “which could result in the property being closed for use for any purpose for a period of one year.”

After the implicit threat, the letter asked the landlord for cooperation, writing, “human trafficking will not end in Virginia without the help of property owners like you. Property owners may be authorized to terminate a tenancy … and are valuable partners in investigating potential illicit activity.”

At the time of the letter, the spa was awaiting trial for two misdemeanor charges: operating a massage parlor without a license and operating a “bawdy house,” which is a house of prostitution.

Descano’s office dropped the prostitution-related charge and accepted a guilty plea on the permit charge — even though the spa still didn’t have a license to operate as a massage parlor. The next day, police shut down the spa for lack of a license, and it never reopened. According to the landlord, the spa moved out on Aug. 31. Currently, the property is vacant and listed for rent.

Descano has repeatedly and publicly stated that he would refuse to enforce democratically passed laws if he ideologically disagreed with them, but his office repeatedly declined to say whether this nullification doctrine applied to prostitution.
