Congress Subpoenas Descano and Kincaid: Sanctuary Policies That Let a Killer Walk Free Are Now a Federal Investigation

Descano Dropped the Charges. Kincaid Ignored ICE. Stephanie Minter Paid With Her Life. Now Congress Is Asking Why.

Sanctuary policies are getting people killed. And now Congress wants to know why Fairfax County’s top Democrat officials let it happen.

The House Judiciary Subcommittee on Immigration Integrity has subpoenaed Commonwealth’s Attorney Steve Descano and Sheriff Stacey Kincaid to testify on April 15. The hearing is titled “Fairfax County, Virginia: The Dangerous Consequences of Sanctuary Policies.” That’s not a political attack — that’s the official name of a congressional investigation into what’s happening in our county.

Here’s what Congress wants to know: Abdul Jalloh, an illegal immigrant with an extensive criminal record, was arrested multiple times in Fairfax County. Descano’s office dropped nearly every charge against him. Kincaid’s office refused to honor ICE detainers that would have turned him over for deportation. So Jalloh stayed free. And then he murdered Stephanie Minter.

This wasn’t bad luck. This was policy. Descano built his office around considering “immigration consequences” when prosecuting crimes — meaning illegal immigrants got special treatment that citizens didn’t. Kincaid made it policy to refuse cooperation with federal immigration authorities. Together, they created a system where a violent criminal kept getting released back into the community.

Former Governor Glenn Youngkin called on then-Attorney General Jason Miyares to investigate Descano for repeated failures to protect Fairfax County residents. That investigation went nowhere. Now Congress is stepping in because local accountability never happened.

The subcommittee says the hearing will examine how sanctuary policies “hurt public safety” and develop legislative reforms. Translation: the federal government is doing what Fairfax County’s Democrat leaders refused to do — hold Descano and Kincaid accountable.

This is why elections matter. Vote them out.
