U.S. Immigration and Customs Enforcement arrested more than 1,300 illegal immigrants across the Washington region this month — 1,328 in a two-week operation, nearly 400 of them already convicted of or charged with crimes, including members of MS-13 and Tren de Aragua. The Trump administration was elected to reverse the illegal-immigration surge of the Biden years, and in the D.C. suburbs it is doing exactly that.

Fairfax County is running the other way. And in September, the two collide.

The September Showdown

On September 3, Israel Flores Ortiz — an illegal immigrant convicted of assaulting nine girls at Fairfax High School — is scheduled to walk out of the Fairfax County jail. ICE has lodged a detainer asking Fairfax to hold him for federal pickup. The Fairfax County Sheriff’s Office, under Sheriff Stacey Kincaid (D), typically does not honor detainers.

The Department of Homeland Security has already drawn its line: it will “arrest and remove” him even if Virginia tries to shield him. That is the fight in one case — Commonwealth’s Attorney Steve Descano (D) and the Sheriff on one side, the Trump administration’s DHS on the other.

Who Wins?

This is not complicated. On one side is a federal government a majority of Americans elected to end the Biden-era border surge. On the other are Fairfax Democrats who have made a policy of going soft on illegal immigrants — including men charged with murder and a man convicted of assaulting schoolgirls.

The 1,328 arrests are the backdrop. The Flores Ortiz release is the flashpoint. And Congress has given Descano until September 7 to hand over the records on exactly this pattern — or face compulsory process. September is going to decide a lot.

Steve Descano’s Greatest Hits

This is not one bad case. It is a record. A partial list of what Descano’s office has done with criminal illegal immigrants and violent defendants:

• Moises Domingo Rico Rosales. Descano’s office dropped two felony drug-distribution charges against an illegal immigrant and let an ICE detainer go unhonored. He was later charged with attempted abduction.
• Abdulloi Toshpulodzoda. An illegal immigrant who killed his Fairfax landlord got an insanity deal instead of a murder conviction — then used a weekend pass to fly one-way out of the country, landing in Tajikistan.
• Abdul Jalloh. An illegal immigrant with more than 40 charges and 30 arrests in Fairfax — most of them dropped by Descano’s office — is now accused of murdering single mother Stephanie Minter at a bus stop.
• Marvin Morales-Ortez. Descano’s office dismissed an assault-and-firearm charge against an alleged MS-13 member here illegally. One day later, he allegedly murdered a man in Reston.
• Thirteen accused murderers. Descano’s office has entered agreements to have 13 accused killers declared legally insane rather than put them on trial.
• Who funded this. Descano won his office with $600,000 from a Soros-funded PAC, and the U.S. Justice Department is now probing whether his office gives illegal immigrants preferential treatment over citizens.
